What happens after an arrest?
After an arrest, the police can detain a person for up to 24 hours for investigation. They might release the person on police bail, without requiring any payment. If more time is needed for investigation, the police can apply for an extension from the Magistrates Court, called a Remand application.
What happens if I am charged?
The IO will provide details about the Court, date, time, and specific offense where the Charges will be read. Subsequently, you will be taken to Court, given the option to claim trial or plead guilty, and referred to as 'the Accused' or 'OKT' after the formal reading.
What should I prepare for ahead of the Charges being brought?
It's advisable for you to designate a Surety and prepare bail funds in advance. You will only be released on bail when all conditions are met.
What happens after I am charged?
After formal charges, the Court schedules case management sessions for the Prosecution and Defense to resolve trial-related issues, exchange documents, and set a trial date.
How long is it before the Trial commences?
This depends on many factors such as the Court in question, its placement in the Court hierarchy, and where the Court is located. As a general guideline however, matters will proceed to trial between 2 – 6 months after the Accused is charged.
